There are laws in place to protect the elderly from abuse. The key to understanding these laws is to first identify that there is, in fact, abuse taking place.

 

Elder abuse is defined as harm against older adults. It can be a single act, repeated acts, or lack of action, occurring in any relationship where harm or distress affects an older person. It can only be called elder abuse if the older adult trusted the one who caused the harm or neglect.

Elder abuse can take the form of sexual, emotional or physical abuse. It can include neglect or desertion, or even the mishandling of their property or money. Anybody can be charged with elder abuse, including family members.

There are state and federal laws in place to protect the elderly. In most states it is mandatory that elder abuse be reported to specific agencies if there is reasonable belief that there has been any form of abuse. Failure to report abuse is considered a misdemeanor, and is punishable by jail time, a fine, or both. In some states, the families of the abused are legally able to sue the person or institution that failed to report the abuse.

State agencies are charged with investigating each claim of elder abuse. These accusations are taken very seriously and if abuse is found, then the individual or institution responsible will be charged according to the nature and severity of the infraction. How to Challenge DWI Arrest Due to Breath Test

Every year people are arrested for a DUI due to the breathalyzer showing that they were driving over the legal limit. While many of these people may have actually been over the legal limit, some of them were not and the breathalyzer test showed incorrect test results. If you have been arrested for a DUI and the court is basing the decision solely upon the breathalyzer test, here’s a look at how you can challenge your conviction in court.

Ask for Actual Blood Results

Breathalyzer tests have been shown in studies to be extremely unreliable. Most states allow officers to make an arrest based off of the results of a DWI breath test, but there has to be a blood test done at the jail to confirm the blood alcohol was over the legal limit.

If you want to challenge the arrest and conviction, ask to see the actual blood test results that show you were driving over the legal limit. Chances are if the court cannot produce them because the blood test was not run, the conviction can be overturned.

Outside Interference for the Breath Test

There are certain medications and drinks that can interfere with the results of the breathalyzer test. Some gums and mouthwash will show trace amounts of alcohol on the breath when there was no actual alcohol drunk. If you want to challenge the arrest, you can bring up the fact that you had the gum or mouthwash prior to the test and therefore the results are inaccurate.

As your son or daughter contemplates their future career choices, it is not uncommon for that of law to come into the picture. It is certainly a great career choice that can be very rewarding. Cultivating this can be important to do, from being supportive to giving advice in terms of classes/degrees to take.

The widespread visibility of law on television does not hurt. Several decades ago courtroom shows appeared, which continue today, such as in the ever-popular “Law and Order” series and its spin-offs. It has done well on the silver screen also, from legal dramas to thrillers and horror movies.

If your child is in high school or college, perhaps you could encourage him or her to take classes in this topic, if an interest is displayed. Government class in high school, and a few options in college (such as political philosophy), can do this quite well. Your child might be able to determine if this is something that would be a good fit.

It is also a good idea to allow your child to see what a career in law looks like. As with any prospective career, be on the lookout for job shadowing opportunities. The more your child sees, the better he or she will be able to determine if it might be right for him or her.
